Terms & Conditions
To provide fair and equal chance of winning to all fans of the Ironwood Custom Builders, Inc Facebook page, the following are the official rules for the Bathroom Remodel Giveaway (hereinafter “sweepstakes” or "prize"). NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING. FACEBOOK DOES NOT ENDORSE THIS SWEEPSTAKES. Open to residents of Salt Lake County, Utah, United States only. All winners must be 18 years of age or older, live within Salt Lake County, Utah United States, and must own the home where the bathroom remodel will be completed.
1. Entering Sweepstakes and Choosing and Contacting Winners- Winners will be chosen by drawing at random from fans or those who have “Liked” the Ironwood Custom Builders, Inc Facebook page (“ICB page” hereinafter). Entrants must “Like” the ICB page on or before October 10th 2011 at 12 noon. It shall be the responsibility of the entrant to verify that they are then listed as a fan of the ICB fan page when they “Like” the ICB page. To verify that you are a fan, go to your Facebook profile and then click on the “info” tab on the left side of the screen, towards the top. Once there, scroll down to the “Show Other Pages” link and see if Ironwood Custom Builders is listed. Ironwood Custom Builders, Inc will not be responsible for entrants who failed to confirm that they are a “fan” or any errors made by Facebook that would prevent entrant from registering as a “fan” after entrant “likes” the ICB page. Winner of the sweepstakes will be notified on the ICB page on October 10th 2011 and shall have 15 days to respond. Should the winner fail to respond within 15 days, ICB may, at its discretion, either draw a second winner or close the sweepstakes without a second drawing. Only one entry per person, per Facebook account. No person may enter the sweepstakes more than once using multiple Facebook accounts. Claiming of prize requires a response to the announcement within 15 days of winner being announced on the ICB page wall. Failure to respond shall mean that the winner forfeits the prize. Ironwood Custom Builders, Inc is not required to award elsewhere any prizes forfeited by the chosen winner.
2. Responsibilities of Ironwood Custom Builders, Inc- Ironwood Custom Builders, Inc (hereinafter ICB) agrees to provide to winner of the Bathroom Remodel Giveaway a remodeled 5’ x 8’ bathroom (hereinafter “Project” or The “Project”) as described below, at no charge to the winner except as described herein. All work described hereinafter shall be performed in one bathroom only and winner may not split up or divide work between multiple bathrooms. Bathroom Remodel shall include: a. Demolition- Removal and disposal of one of each of the following: bath tub, tile flooring, vanity, sink, tub fixture and valve, tub tile, any bath hardware (towel bars, toilet paper holders, etc), light fixture, and toilet. b. Drywall- Patch and repair damage done to the existing drywall or plaster due to (a.) above. c. Plumbing & Electrical- Install new plumbing fixtures and light fixture as provided by our sponsor to included (1) white cast iron bath tub, (1) toilet, (1) undermount porcelain sink, (1) bath faucet, and (1) vanity light. Provide and install new outlet and light switch. d. Tile- Install new tile flooring, baseboard, and tub surround to 84” off the floor. Allowance for material is $3.50/square foot. No geometrical patterns or designs are included e. Paint- Provide 1 coat of primer over raw drywall surfaces and 2 coats of paint on walls and ceiling. Existing door and casing are not included. Walls and ceiling color shall be the same color and same sheen. f. Hardware- provide and install (1) bath towel rack, (1) hand towel rack, and (1) toilet paper holder as provided by our sponsors. g. Cabinets- provide and install (1) 36” wide knotty alder bathroom vanity, 30” tall h. Countertops- Provide and install granite countertop with 1 ½” mitered edge. Winner is required to select a remnant piece of granite from the Distinctive Marble and Granite slab yard. i. Building Permit- included if required in the winners municipality. j. Dumpster- provide (1) 7 yard dumpster for (1) dump. Winner will not be credited for nor shall winner recieve materials not used should winners chosen bathroom be smaller than 5x8, or for any other reason that would require ICB to use all of the prescribed materials as contained/outlined herein. EXCLUSIONS: Anything not explicitly stated in these Terms and Conditions is excluded including but not limited to anything that is subsurface that causes an increase in the cost to complete the Project, including but not limited to multiple layers of flooring, upgrading any plumbing or electrical systems in the bathroom to the current plumbing or electrical code, damage caused to existing systems due to the work described herein, replacement of worn out or damaged water shut-off’s, or any other work that may be required to complete the Project.
3. Responsibilities of Winner- Winner acknowledges and agrees that Ironwood Custom Builders, Inc may use winners name, any before and after pictures of winners bathroom and/or home, any interviews with winner, and any other information gathered about the Project in any way that Ironwood Custom Builders, Inc sees fit which may or may not include but not be limited to any televised media, print media, or online media. Winner hereby agrees to hold Ironwood Custom Builders, Inc and its subcontractors, suppliers, affiliates, subsidiaries, licensee’s sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the Project. Winner will allow ICB access to the home where the bathroom Project will occur for the duration of the Project, Monday through Saturday from 7:00 am until 7:00pm for the aproximately 4-6 weeks it will take to complete the Project. Should winner fail to allow access, ICB May terminate the Project without further notice and choose, at its discretion, whether to complete the project at a later date or to not complete the Project. If ICB chooses to terminate this agreement ICB shall have no further obligation to winner and winner shall have no claim against ICB. Winner shall be required to agree to and sign a copy of these Terms & Conditions in addition to a Bid Proposal, upon acceptance of prize in order to make this agreement binding, before Ironwood Custom Builders will commence with he Project. Should winner fail to comply with any terms contained herein or in Bid Proposal, Ironwood Custom Builders, Inc, may terminate this agreement, at its sole discretion, without completing the Project, and shall bear no additional responsibility or have any liability for the incomplete project. The bathroom remodel is non-transferable and winner must be able to start project within 30-60 days. If winner is unable to conform with or comply with any of these terms and conditions, they will forfeit the prize.
4. Awarding Prize- Winner is solely responsible for all taxes and/or fees that may be incurred and all such additional costs that may be incurred. Winner shall provide proof of ownership of home and supply Ironwood Custom Builders, Inc with his/her legal name, mailing address, birth date, daytime and nighttime telephone numbers. Winner may forfeit the entire prize if verification cannot or has not been made within 15 days of request by Ironwood Custom Builders, Inc. Upon proper verification, winner’s signature on these Terms and Conditions, and execution of Bid Proposal, Ironwood Custom Builders, Inc will commence with the Project. Winners may request substitutions of items included in the Project as described herein, but shall be required to pay entirely for the substituted items, without credit for the included items, in full before the Project commences. Should the bathroom in the home that winner selects as the one that they wish to have remodeled, be larger than 5’ x 8’, winner shall be responsible for the additional costs required to complete the project which would include but not be limited to additional flooring, larger vanity, 2nd sink and faucet, etc. Should winner choose not to pay for any additional labor and or material required ot complete a larger bathroom than 5' x 8', winner will forfeit prize.
5. Additional Terms and Conditions- Neither Ironwood Custom Builders, Inc, Ironwood Custom Builders, Inc sponsors, nor employees of Ironwood Custom Builders, Inc or its subcontractor and suppliers or sponsors may be held liable for any warranty, costs, damage, injury, or any other claims incurred as a result of construction of the Project, during the construction of the project, or usage of the completed Project. Winner shall be responsible for keeping occupants of the home and guests out of and away from the Project area, and shall be solely responsible for any injuries sustained by any occupants of the home, or guests of the winner, in the Project area, and furthermore agrees to hold harmless Ironwood Custom Builders, Inc if any such injuries occur in the house while ICB employees, subcontractors, suppliers, or sponsors are in the home for the duration of the project. Ironwood Custom Builders, Inc is not liable for any loss arising out of or in connection with the Project. If the specified prize becomes unavailable due to unforeseen circumstances or if any sponsor withdraws for any unforeseen reason, Ironwood Custom Builders, Inc may substitute a prize of like or equal value, or withdraw the prize altogether, at its sole discretion. For the name of the contest winner, send an email to bathgiveaway@IronwoodCustomBuilders.com with "Winners Name" in the subject line. Management, employees and families of Ironwood Custom Builders, Inc, it’s subcontractors, suppliers, or their family members, in addition to any current or previous clients of Ironwood Custom Builders, Inc are prohibited from winning any prizes awarded by Ironwood Custom Builders, Inc. Ironwood Custom Builders, Inc reserves the right to alter any rules of this sweepstakes at anytime.
